A INQUIRIÇÃO PROTEGIDA DA LEI MARIA DA PENHA COMO RESPOSTA NORMATIVA À INJUSTIÇA EPISTÊMICA TESTEMUNHAL: UMA LEITURA DOGMÁTICA DO ART. 10-A, § 2.º, INCISOS I A III, DA LEI N.º 11.340/2006

O artigo examina a inquirição protegida da mulher vítima de violência doméstica, disciplinada pelo art. 10-A, § 2.º, I a III, da Lei n. º 11.340/2006, à luz, em especial, da teoria da injustiça epistêmica testemunhal. Sustenta-se que o processo penal ordinário produz injustiça epistêmica estrutural por três mecanismos cumulativos, quais sejam, o ambiental, procedimental e documental, operando por silenciamento e por hiperlegitimação, e que as proposições contidas em cada um dos incisos do referido § 2.º têm aptidão para atenuar ou corrigir esses mecanismos. Conclui-se que os três incisos não são meras diretrizes, mas condições normativas de confiabilidade epistêmica do relato, cuja observância integra a valoração do depoimento e deve ser motivada.
