A preocupação jurídica com os impactos da atividade humana sobre o meio ambiente remonta ao final do século XIX, mas a degradação ambiental contemporânea atinge magnitude inédita diante das incertezas e riscos gerados pelo acelerado progresso técnico-científico. As interferências antrópicas intensificam catástrofes ambientais, contribuem para o desequilíbrio ecológico e deterioram recursos essenciais à sobrevivência humana. Esse cenário demanda respostas internacionais compatíveis com os atuais desafios ambientais. O presente trabalho analisa a necessidade de um regime jurídico capaz de suprir a lacuna normativa existente e assegurar proteção adequada aos direitos fundamentais dos chamados “refugiados ambientais”, articulando tal proteção com estratégias de prevenção e enfrentamento das causas ambientais da mobilidade forçada.
